Although there are few barriers to entry in the labour recruitment industry, companies wishing to operate legally in South Africa do need to comply with several different pieces of legislation and to register with certain bodies.
This section is designed to provide some information on where to register and ease of access to the applicable laws and where possible, the registration forms. Although all attempts have been made to ensure accuracy, individuals wishing to start their own recruitment company are advised to do their own research and liaise with applicable professionals for the accounting, tax and legal aspects of opening a business.
In order to qualify for APSO membership, the recruitment company needs to comply with all applicable legislation that affects those working within the labour recruitment industry. One of APSO’s main functions is to keep abreast of changes in legislation that may affect the labour recruitment industry. APSO is a founding member of the Confederation of Associations in the Private Employment Sector (CAPES). CAPES is the lobbying body of the labour recruitment industry and is very actively involved in protecting the interests of its members. For more information on CAPES visit www.capes.org.za
Recently, the government has published several proposals of changes to pieces of legislation that could adversely affect the labour recruitment industry. Members can rest assured that APSO, via CAPES, is on top of this and working hard towards ensuring that appropriate responses are forwarded to the government departments concerned and that action is taken at NEDLAC and other appropriate forums.
