Ministerial Determination

Dear APSO member




 Please be advised that APSO and AHASA have commenced with the annual Ministerial Determination consultation with the four relevant Trade Unions namely:  HOSPERSA, NEHAWU, DENOSA and Solidarity.  In addition to the items below, consultation is also underway to extend the period of the Determination from one to two years.


 Variation is being sought from the Minister of Labour in terms of BCEA Section 50:


 A.            Variation in terms of Section 20(11):

Instead of granting annual leave, to rather pay out the annual leave as required in terms of Section 40(c)(i) for all employees working through the agency - (1 hour for every 17 hours worked).

 B.            Variation sought in terms of Section 22(1) and (2):

Instead of working on the 30 days per 36-month cycle of sick leave, to apply the formula of Sec 22(3) of one day’s paid sick leave for every 26 days worked for the duration of the 36-month cycle.
